Terms of Service — ChargeMeCar

These Terms of Service ("Terms") govern the use of the ChargeMeCar platform and website. They form a legal agreement between the charging station owner ("Owner", "you") and FROG IT SARL ("ChargeMeCar", "we"). By registering at cloud.chargemecar.com you accept these Terms. Our Privacy Policy and Cookie Policy form part of these Terms.
1. Parties and subject
FROG IT SARL, a company registered in France (Bureau 3, 50 Boulevard Stalingrad, 06300 Nice, France), provides the Owner with access to the ChargeMeCar charging station management platform: connection of charging stations (OCPP 1.5, 1.6, 2.0.1), the owner portal, the driver application and QR payment page, tariffs, receipts and roaming, together with technical support.
ChargeMeCar is a service for companies and private individuals who own charging stations. It is not limited to any territory: the only condition for accepting payments is a Stripe account of the Owner in a country where Stripe operates.
2. Fees and settlement
Registration, the owner portal, the driver application and the connection of stations are free of charge.
"Payment acceptance" plan. The Owner accepts driver payments to their own Stripe account. ChargeMeCar's fee is 8% of each paid charging session. The fee is withheld automatically from each driver payment at the moment the payment is captured; the remainder is credited to the Owner's Stripe account immediately. The Owner receives a monthly statement listing every session and the fee withheld; this statement is an accounting document and is not a request for payment. The plan is activated by connecting the Owner's Stripe account in the portal ("Connect with Stripe") and ends when it is disconnected.
Driver payments are made directly to the Owner: the payment is processed in the Owner's Stripe account, the receipt is issued by Stripe in the Owner's name, and ChargeMeCar is not the recipient of these funds. Stripe's own processing fees are charged by Stripe to the Owner under the Owner's agreement with Stripe.
"Own fleet" plan (no driver billing). While the Owner has no more than 3 active stations, the service is free. From the moment the number of active stations exceeds 3, all of the Owner's stations, including the first 3, are billed on the energy actually delivered at a flat rate of 0,0216 € per kWh, regardless of connector mode or power. Settlement is made from the Owner's prepaid balance: the Owner tops up the balance in the portal (minimum top-up 100,00 €); the cost of each session is debited when the session ends, and an itemised invoice is generated for each session. If the balance is insufficient, only the start of new sessions is suspended until the balance is topped up; the stations remain connected and the Owner's data is retained.
The current fee and rate are published on the website and in the portal. They are fixed at the moment of acceptance and change only in the manner described in section 7.
3. Obligations of the parties
The Owner configures the payment connection, driver tariffs and business details in the portal at cloud.chargemecar.com, and ensures the stations and their network connectivity operate correctly.
The Owner is responsible for the accuracy of their business and payment details, for the tax treatment of the funds received (including VAT), and for compliance with the consumer and price-transparency rules that apply to public charging in the Owner's country (in the EU, Regulation (EU) 2023/1804 — AFIR).
ChargeMeCar keeps the platform operational and provides support on business days (Monday–Friday, 09:00–18:00 Paris time) by e-mail at info@chargemecar.com.
4. Liability
ChargeMeCar is not responsible for the condition or operation of the Owner's charging stations, for the actions of drivers, or for decisions taken by Stripe regarding the Owner's account.
The Owner is responsible for the correctness of the tariffs they publish and for the receipts issued in their name.
Our total liability to the Owner arising out of these Terms is limited to the total fees withheld or paid by the Owner in the twelve (12) months preceding the event giving rise to the claim. We are not liable for indirect or consequential loss, including loss of profit, business or data.
Neither party is liable for failure to perform caused by circumstances beyond its reasonable control (force majeure).
5. Term and termination
These Terms take effect upon the Owner's registration at cloud.chargemecar.com and remain in force until terminated.
Either party may terminate with seven (7) calendar days' notice sent to the e-mail address of the other party. Disconnecting the Stripe account ends the "Payment acceptance" plan without terminating these Terms.
Termination does not release the parties from obligations that arose before it. Fees withheld before termination are not refunded; an unused prepaid balance is refunded on request.
6. Personal data
The Owner's business and contact data, and the data of drivers using the Owner's stations, are processed in accordance with the General Data Protection Regulation (EU) 2016/679 and our Privacy Policy. Payment card data is processed by Stripe and is not stored by ChargeMeCar.
7. Changes to these Terms
We may change these Terms, the fee and the rate by publishing a new version on the website and notifying the Owner by e-mail at least fourteen (14) calendar days before it takes effect. Continued use of the platform after that date constitutes acceptance. An Owner who does not accept the changes may terminate under section 5 before they take effect.
